These Terms of Service ("Terms") govern your access to and use of FormGatekeeper (the "App," "we," "our," or "us"), a Shopify application that lets merchants build application forms, review submissions, and tag or create Shopify customers. By installing or using the App, you agree to these Terms.
To use FormGatekeeper you must operate an active Shopify store and install the App through Shopify. Authentication is handled entirely by Shopify; we do not maintain a separate username or password. You are responsible for maintaining the security of your Shopify account and for all activity that occurs under your store.

You are the data controller for the information your forms collect from applicants. You are responsible for obtaining any consents required, for maintaining your own privacy policy, and for handling applicant requests in accordance with applicable laws such as GDPR and CCPA. FormGatekeeper acts as a data processor that stores and processes this data on your behalf. Our handling of data is described in our Privacy Policy.
FormGatekeeper offers a free tier and one or more paid plans. All charges are billed through the Shopify Billing API and appear on your Shopify invoice. By selecting a paid plan you authorize Shopify to bill you on a recurring basis until you cancel. Plan limits, prices, and features are shown at the time of purchase and may change with notice. We do not process payments directly and do not store payment card information.
The App depends on Shopify and on third-party providers (including Resend for email and Railway for hosting). Your use of the App is also subject to Shopify's terms. We are not responsible for outages, changes, or actions of these third parties. If Shopify revokes our access or you uninstall the App, your ability to use it will end.
The App, including its code, design, and branding, is owned by us and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for your store. You retain all rights to the form content and submission data you create or collect.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will meet your specific requirements.
To the maximum extent permitted by law, FormGatekeeper and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the App. Our total aggregate liability for any claim will not exceed the amount you paid us for the App in the three months preceding the claim, or USD $100 if you are on the free tier.
You agree to indemnify and hold harmless FormGatekeeper and its operators from any claims, damages, liabilities, and expenses arising from your use of the App, your form content, the data you collect, or your violation of these Terms or applicable law.
You may stop using the App at any time by uninstalling it from your Shopify admin. We may suspend or terminate your access if you violate these Terms or if required to protect the App or other users. On termination, the licenses granted to you end. Data deletion following uninstall is described in our Privacy Policy and follows Shopify's mandatory data-redaction process.
We may update these Terms from time to time. Changes will be posted at this URL with an updated date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which the App operator is established, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless applicable law requires otherwise.
